BREAKING: Trump Reportedly Laying Groundwork to Declare National Emergency Over Fabricated Election Fraud Claims
Voting experts are sounding the alarm after a summer of coordinated moves that appear designed to give Trump a pretext for declaring a national emergency over the midterms.
Trump used a primetime address in July to repeat the lie that the 2020 election was stolen from him. His own former strategist Steve Bannon predicted publicly what was coming next. “Take your No 2 pencil out,” Bannon said on his podcast in late July. “It’s coming. It’s coming. Just block the last week of August out.” Asked directly whether he’d declare a national security emergency over elections, Trump didn’t deny it. “Stranger things have happened, OK? I’ll leave it at that.”
Since then, a White House task force has released a rapid succession of declassified documents, each one stretched to suggest widespread noncitizen voting despite the numbers not holding up. A Census Bureau brief claimed 24,000 noncitizens voted in 2020 without disclosing its methodology. David Becker, executive director of the Center for Election Innovation and Research, didn’t mince words. “This alleged analysis based on census data fails the laugh test,” he said. A separate DHS claim of 278,000 noncitizen registrations used a tool known to be inaccurate, also without releasing its methodology.
Aria Branch, a partner at Elias Law Group who has already successfully sued to block earlier Trump election orders, said the pattern is unmistakable. “Noncitizen voting in our elections is just not a widespread problem,” she said. “All of the fear and narrative around that issue is just completely unfounded, and it’s really just to stoke fear and lay the groundwork for future action.”
Here’s the good news buried in all of this: the Constitution doesn’t bend to a press release. Experts agree a national emergency declaration would not override the constitutional limits on executive control of elections. No president has ever successfully claimed that power, and legal groups like Elias Law Group are already positioned to fight it in court the moment it’s attempted. Santiago Mayer of Voters of Tomorrow put the real strategy plainly. “Our focus at the end of the day is to turn out enough voters where, no matter what he pulls, it won’t succeed.”
That’s the actual answer here. Not panic, preparation. Democrats in Congress have reportedly been running through response scenarios for months. Voting rights organizations have been preparing legal challenges in advance. The playbook to stop this isn’t a secret, it’s turnout and readiness, and both are already in motion.
